The department having decided the question of rank in the case of Captains E. R. Smith Co. "G" and E. J. March Co. "F" of the 29th Va Regt, awarding the seniority in favor of the former officers, I respectfully ask that a letter of appointment as Major be issued him to date April 9th 1863 the date of the acceptance of the resignation of Col. A. T. Moore, and of Lieut Colonel from June 2nd 1864, the date of death of Lt. Col. Haynes of wounds received at Drewry's Bluff, May 14th 1864. Captain Smith passed a satisfactory examination last August when the question of rank was raised between him and Capt. March.

In reply to your letter of the 30th ult., you are respectfully informed that it has been decided, and is now the rule of the Department, that Captains having [...] companies rank from the vote of their entry into the Confederate service, usually evidenced by the mustering in, sometimes by the date of the first order.
Companies authorized by the War Department enter the service on the day they organize by the election of officers and commissions date from that day. There is not authority to autodate commissions.
